In a major win for Pennsylvania’s medical marijuana industry, the Commonwealth Court granted preliminary relief to medical marijuana operators represented by Cannabis Law Solutions. The ruling blocks the Department of Health from enforcing its restrictions on certain additives, known as botanically derived terpenes, in vape products.
The Court found that Petitioners raised serious legal questions about whether the Department went beyond its authority and relied on a rule that was never properly adopted. It also pointed to the Department’s uneven approach, allowing some products to remain on the market while prohibiting others.
With the restrictions blocked, the case now moves forward on the merits.
