Yesterday, the Administrative Law Judge overseeing the hearing to determine whether cannabis should be moved to Schedule III under the Controlled Substances Act denied a request by prohibitionists to reopen the record. The anti-rescheduling parties wanted to present addition testimony and evidence related to the novel 2-part Currently Accepted Medical Use (CAMU) that was adopted by the FDA as part of the rescheduling process. The Judge did however accept a report from the U.S. Government Accountability Office (GAO) which points out “gaps” in the written rescheduling policies that the prohibitionists seek to use to paint the rescheduling effort as fatally defective. Briefing will conclude in the first week of November and there is no timeline on when the judge will issue his final recommendation.
