On Friday, the Attorneys General for Indiana, Nebraska, and Louisiana filed a Petition for Review (lawsuit) in the D.C. Circuit Court challenging President Trump and Attorney General Blanche’s April 28th Order rescheduling FDA-approved and state-regulated medical marijuana to a Schedule III substance. Like SAM’s challenge, it is a 2-page filing that seeks to attack the process the Trump Administration used in issuing the Order and the legality of the order. The States ask the D.C. Circuit to declare the rescheduling “unlawful” and to “vacate” the order.
Curiously, at the state level, Nebraska and Indiana have legalized medical marijuana to some degree. In 2020, Louisianna enacted a medical marijuana law that currently provides for 2 suppliers and 9 dispensary outlets state-wide. In 2024, in a ballot initiative where 66% of the voters voted to legalize medical marijuana, there have been on-going fights concerning the state legislature refusal to implement the results of the proposal—just last month, it appears the will of Nebraskans is finally being implemented.
